Terms of Use

1. Purpose

These Terms and Conditions of Use (hereinafter the « Terms ») set out the terms and conditions under which the company RUCK ZONE makes available to users (hereinafter the « Users ») the services accessible on the websites ruck-zone.fr and itsrugby.fr (hereinafter the « Sites »), as well as the conditions under which these services are used by Users.

2. Publisher

The Sites are published by RUCK ZONE, a simplified joint-stock company (société par actions simplifiée) with share capital of €1,000, whose registered office is located at 133 bis rue de l’Université, 75007 Paris (France), registered with the Paris Trade and Companies Register (RCS) under SIREN number 942 690 918. 3. Description of services

The Sites offer the following services:

  • ruck-zone.fr: an online media outlet dedicated to professional and amateur rugby, offering articles, news, analysis, interviews, audio and video content, interactive content and live match broadcasting.
  • itsrugby.fr: a sports and statistics database dedicated to rugby, allowing consultation of biographical, sporting, historical and statistical information relating to rugby’s participants (players, referees, staff, executives, presidents), clubs, competitions, matches and stadiums.

Depending on the pages and the User’s eligibility, the following features may be available:

  • Accounts and professional profiles (supporter, player, club, staff, referee, president, journalist, partner bar) with specific visibility rules.
  • Claiming and managing a profile: an eligible User may request to manage their profile (player, club, staff, president, referee). To validate this request, RUCK ZONE may need to request supporting evidence (for example a licence); this evidence is optional, kept only for the duration of the verification and then deleted. RUCK ZONE reserves the right to refuse or revoke a management request at any time in the event of doubt as to the legitimacy of the requester.
  • Social module: follow other members (follow), optional public profile, activity feed of one’s network, in-app notifications, likes.
  • Predictions: play single or bundled predictions on matches, accumulate points, appear in the public anonymised leaderboard (the leaderboard never displays players’ usernames or names).
  • Polls: vote on opinion polls, anonymously (without creating an account) or whilst logged in.
  • Classified ads: publish or view recruitment classified ads relating to bars, clubs, players and staff; certain ads are gated and reserved for registered clubs.
  • Partner bars: accounts at « Bar » level are subject, in addition to these Terms, to a specific Partner Bar Charter governing the B2B partnership (mutual commitments, broadcasting rights, liabilities, GDPR on the bar’s side).
  • Private messaging between members: exchange private messages with other members in connection with recruitment ads (player, staff, club seeking a player or staff ads), without disclosing one’s email address. The User may disable their messaging, block another member, or report a message to moderation. For volunteering and event ads, an « I’m interested » button allows an expression of interest to be sent to the author. Ads in the Bars Calendar do not have messaging.
  • Partner bars calendar: view and publish events organised in rugby bars.
  • Visitor contributions (UGC): submit photos and videos without prior account creation, for editorial publication following moderation and subject to applicable rights assignments.
  • Live match coverage: follow matches live with text commentary and minute-by-minute events.

Some features are freely accessible; others are reserved for Users holding an account and, depending on the case, an eligible professional profile.

4. Acceptance of the Terms

Use of the Sites implies full and unreserved acceptance of these Terms. When creating an account, the User is invited to expressly accept the Terms by means of a dedicated tick box. This acceptance is a necessary condition for registration. The User acknowledges having read the Terms before accepting them.

If the User does not accept all or part of these Terms, it is their responsibility not to use the Sites.

5. Access to the services

Access to the Sites is open to any person with access to the Internet. Costs relating to such access (equipment, connection, Internet subscription) are borne solely by the User.

Access to certain features is subject to:

  • the prior creation of a user account;
  • compliance with these Terms.

RUCK ZONE reserves the right, without notice or compensation, to temporarily or permanently close the Sites or access to one or more services, in particular to carry out an update, maintenance operations or modifications. RUCK ZONE cannot be held liable for any consequences of such interruptions on Users’ activities.

6. Creating and managing an account

Registration conditions: account creation is open to any adult natural person or minor duly authorised by their legal representative, as well as to any duly represented legal entity. The User undertakes to provide accurate, complete and up-to-date information when registering, and to update it in the event of any change.

Credentials and security: the User is responsible for the confidentiality of their credentials (email address, password). Any action carried out from their account is presumed to have been carried out by them. In the event of unauthorised use of their account, the User undertakes to inform RUCK ZONE without delay at hello@ruck-zone.fr.

Single account: each User may hold only one account. The creation of multiple accounts or combined profiles (for example player and staff on the same account) is prohibited, except where an exception is expressly provided for (for example Bar accounts may manage several establishments).

Types of profiles: depending on the features used, the User may be linked to a professional profile (supporter, player, club, staff, referee, president, journalist, partner bar). Each profile follows its own eligibility and visibility rules.

Suspension and closure by RUCK ZONE: RUCK ZONE reserves the right to suspend or delete any account presenting manifestly inaccurate or fraudulent information, or that does not comply with these Terms, without notice or compensation, and without prejudice to any action for damages.

7. User obligations

The User undertakes to use the Sites in compliance with applicable laws and regulations, as well as with these Terms. In particular, the User shall not:

  • infringe public order, public morality or the rights of third parties;
  • use the Sites for illegal or fraudulent purposes, or in a manner that infringes the rights and interests of third parties;
  • attempt to access restricted areas without authorisation, or circumvent technical protection measures;
  • extract, reproduce or reuse in a substantial manner, whether qualitatively or quantitatively, the content of the itsrugby.fr database, other than for normal individual consultations provided for by the service;
  • use robots, scrapers, automated scripts or any similar device to collect or extract data from the Sites;
  • publish or transmit content that is unlawful, defamatory, abusive, racist, xenophobic, hateful, pornographic or that infringes the integrity or dignity of persons;
  • impersonate a third party or provide deliberately inaccurate information;
  • use private messaging to send unsolicited messages for commercial purposes (spam), mass canvassing, or to harass, intimidate or discriminate against another member; circumvent the audience rules of ads (for example by fraudulently claiming a profile in order to access reserved contacts);
  • transmit viruses, malicious code or any element likely to harm the proper functioning of the Sites.

Any breach of these obligations may result in the suspension or deletion of the account concerned, without prejudice to any legal proceedings.

8. Content published by Users

When a User publishes or transmits content (comment, photo, message, prediction, etc.), they warrant that they hold, or have the necessary rights to, such content, and remain responsible for it.

By publishing content on the Sites, the User grants RUCK ZONE a non-exclusive, royalty-free, worldwide licence, for the statutory duration of the rights concerned, authorising RUCK ZONE to host, reproduce, display, adapt and distribute such content solely for the purposes of operating and promoting the Sites.

RUCK ZONE reserves the right, without notice or compensation, to moderate, move or delete any content it considers contrary to these Terms, the law or its editorial policy.

Private messages: messages exchanged via the internal messaging system are confidential and accessible only to their recipients. RUCK ZONE only accesses the content of a message thread in the event of a report by a user, solely for moderation purposes, and in accordance with the Privacy Policy. Each consultation by an administrator is logged in an audit trail. Retention, erasure and the associated rights (export, blocking, global opt-out, reporting) are set out in the Privacy Policy.

Liability outside messaging: each User is solely responsible for the content they publish in their messages, including where they disclose their own contact details (email, telephone, other). If Users choose to continue their exchanges outside the platform (direct email, telephone, other messaging service, in-person meeting, etc.), such exchanges no longer fall within the service provided by RUCK ZONE. RUCK ZONE is not responsible for the content, use or consequences of such off-platform exchanges, nor for the use each User makes of contact details voluntarily provided by another member.

9. Free of charge service

Free access: access to the Sites and their features is provided free of charge. No paid subscription is marketed and no payment is requested from the User for creating an account or for access to the content and services described in Article 3.

Funding: the service is funded by advertising and commercial partnerships, under the conditions described in the Privacy Policy.

Evolution of the offering: RUCK ZONE reserves the possibility of introducing paid offerings in the future. If so, their pricing and terms would be brought to the User’s attention before any subscription and would be reflected in an update to these Terms.

10. Intellectual property

Content of the Sites: the Sites, their structure, their arborescence, their graphic design, their texts, photographs, videos, sounds, logos, trade marks, illustrations, distinctive signs, as well as the sports and statistics database compiled by RUCK ZONE, are protected under the provisions of the French Intellectual Property Code (Code de la propriété intellectuelle) and belong to RUCK ZONE or its rights holders.

Database: the database accessible via itsrugby.fr is protected under the sui generis database producer’s right (articles L. 341-1 et seq. of the French Intellectual Property Code). Any extraction or reuse that is qualitatively or quantitatively substantial of the database’s content is prohibited without RUCK ZONE’s prior written authorisation.

Authorised use: unless expressly authorised otherwise, the User is authorised to consult the Sites for personal, private use. Any reproduction, representation, distribution or reuse for other purposes, in whole or in part, is strictly prohibited and may constitute an act of infringement.

Trade marks: the trade marks, logos and distinctive signs reproduced on the Sites are the property of their respective owners. Any reproduction or use without authorisation is prohibited.

11. Personal data

The processing of personal data carried out in connection with the Sites is governed by a dedicated policy, available at /privacy-policy/. This policy sets out the purposes, legal bases, retention periods, recipients, any transfers outside the EU, as well as the arrangements for exercising data subjects’ rights (access, rectification, erasure, objection, restriction, portability, withdrawal of consent).

12. Cookies and trackers

The use of cookies and trackers on the Sites is governed by the Cookie Policy. The User may withdraw or change their consent at any time via the consent management platform (Didomi) accessible from the footer of the Sites.

13. Liability

Obligation of means: RUCK ZONE undertakes to implement reasonable means to ensure the availability, quality and accuracy of the information published on the Sites. RUCK ZONE is bound by an obligation of means, not an obligation of result.

Limits: RUCK ZONE cannot be held liable for:

  • inaccuracies or omissions concerning the sporting and statistical information published, such information coming from third-party sources or from the database and being subject to updates;
  • temporary interruptions of the Sites, in particular for maintenance or in the event of force majeure;
  • indirect damage resulting from the use of, or inability to use, the Sites;
  • the content of third-party websites to which hyperlinks may lead;
  • content published by Users themselves;
  • private exchanges between Users via the internal messaging system, the content and consequences of which are the sole responsibility of their authors, without prejudice to RUCK ZONE’s right to moderate reported messages.

The User is solely responsible for the use they make of the information consulted on the Sites, as well as for the direct or indirect consequences of such use.

14. Force majeure

RUCK ZONE cannot be held liable for any delay or failure to perform its obligations in the event of a force majeure event within the meaning of article 1218 of the French Civil Code. Force majeure events include, in particular, failures or breakdowns of networks or servers external to RUCK ZONE, cyberattacks, decisions of administrative or judicial authorities, industrial disputes, and natural or health disasters.

15. Amendment of the Terms

RUCK ZONE reserves the right to amend these Terms at any time to take account of legal, regulatory, technical or editorial developments. Users are informed of any substantial amendment by a notice published on the Sites or sent by email. Continued use of the Sites after the new Terms take effect constitutes acceptance of them. The date of last update appears at the head of these Terms.

16. Termination

By the User: the User may delete their account at any time from their personal area or by sending a request to hello@ruck-zone.fr.

By RUCK ZONE: RUCK ZONE may terminate a User’s account, without notice and without compensation, in the event of a serious breach of these Terms, in particular in the event of fraud, unlawful content, infringement of third-party rights, an attempt at mass extraction of the database, or use contrary to the editorial policy.

Termination results in the loss of access to reserved content and features. Account data is retained within the limits provided for in the Privacy Policy.

17. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute relating to their interpretation or performance, the parties shall endeavour to reach an amicable solution. Failing this, the dispute shall be submitted to the competent French courts under ordinary law rules, subject to the mandatory provisions applicable to consumers.

18. Consumer mediation

In accordance with articles L. 611-1 et seq. of the French Consumer Code (Code de la consommation), a consumer User has the option, after a prior written complaint sent to RUCK ZONE that has not received a satisfactory response, to have free recourse to a consumer mediator with a view to the amicable resolution of the dispute. The competent consumer mediator may be contacted online via the European online dispute resolution platform: https://ec.europa.eu/consumers/odr/.
